Texas Dem U.S. Senate Primary Is A 4-Way Street

Whereas political contributions are not always the best indicators of election outcomes, politicos largely agree that they are very good indicators of voter enthusiasm. Yours Truly recently scoured through the Federal Elections Commission’s (FEC) data on the Democratic contenders for the Texas U.S. Senate seat currently held by Republican John Cornyn and came up with some interesting findings.

According to FEC data, M.J. Hegar is leading the Dem hopefuls in the amount of political contributions raised ($2,058,080.28), followed by Amanda Edwards($557,430.43), Royce West($551,266.18) and Cristina Tzintzun Ramirez($459,442.70) respectively. (see image below–candidates per Ballotpedia). Any reasonable person looking at this FEC data would therefore surmise that as it currently stands, Texas voters are most enthusiastic about Mary Jennings going up against incumbent GOP Senator John Cornyn in 2020.

There are however some interesting observations which must be taken into account. M.J. Hegar’s figures cover the period from 1/1/2019 to 9/30/2019 presumably because she declared her candidacy earlier. Both Amanda Edwards’ and Royce West’s figures cover the period 7/1/2019 to 9/30/2019(3 months). Cristina Ramirez’s numbers are from 7/29/2019 to 9/30/2019(2 months). M.J. Hegar’s numbers therefore reflect a good 7-month advantage over Edwards, West and Ramirez. Is that why M.J. is widely leading the pack in money?

It is also worth pointing out that M.J. Hegar, Amanda Edwards, and Royce West have all previously vied for Texas elective office. It is therefore not clear whether the amounts they currently have are rollovers from previous campaigns or whether they are monies raised specifically for their 2020 U.S. senate runs. M.J. Hegar you will remember unsuccessfully contested TX-31 congressional seat in 2018. Amanda Edwards currently holds a seat at Houston City Council, a position she has held since January 2016. Royce West is a Texas State Senator representing the 23rd district(Dallas).

Cristina Ramirez has never held any elective office in Texas or elsewhere, but is a very well known(and very popular) community organizer mostly recognized as a co-founder of the Workers Defense Project. Given the fact that Cristina Tzintzun Ramirez has never run for elective office before, the impressive $459,442.70 she raised in a 2-month period, should catch the attention of Texas politicos–certainly has caught Yours Truly’s.

For some of the candidates, there is no available FEC data so it is hard to gauge where they stand with voters. Pastor Michael Cooper’s campaign is in the red $680.10 and Adrian Ocegueda has only managed $1048.73 in political contributions. No right thinking person could ever ascribe viability to either Pastor Cooper’s or Ocegueda’s political campaigns given that the primary is only three months away.

Bottom line folks, as Yours Truly stated earlier, money is not always the best indicator of election outcomes. It is however a very good barometer for voter enthusiasm and as it currently stands, it appears Texas Democrats are enthusiastic about the prospects of Mary Jennings, the self-described “ass-kicking, motorcycle-riding Texas Democrat” going up against GOP’s incumbent Senator John Cornyn in November 2020. The Texas Democratic Party primary is scheduled for March 3, 2020. As President Trump famously says, “We’ll see what happens.”

Texas Secretary Of State Allowed GOP To Violate State’s Election Law For Decades

An interesting feud that could have national political implications has erupted between two Texas women–Harris County Clerk Diane Trautman, a Democrat, and Texas Secretary of State Ruth Rugerro Hughs, a Republican. At issue is a last minute advisory Secretary of State Hughs’ office handed County Clerk Trautman on how to handle votes cast during the Houston Mayoral race that according to Trautman, resulted in a 12 hour delay in announcing the election results. The 12 hour delay in announcing election results has generated a lot of finger-pointing with Republicans blaming it on Democrat Trautman and Trautman in turn placing the blame squarely on GOP Secretary of State Hughs’ office..

Houston’s Mayoral elections were held on November 5, 2019 and are headed for a December 14, 2019 runoff because no candidate managed to get a majority of the vote(more than 50%). Early voting began on October 21, 2019. On October 23, with early voting already underway, Texas Secretary of State Hughs’ office issued an advisory directing all Texas counties to make copies of election result data before transmitting them electronically. This would ensure that the county had a backup in case hacking was suspected or alleged during electronic transmission of election results.

The problem with this seemingly prudent advisory from Secretary of State Hughs’ office is that it was such a last-minute advisory(issued after early voting commenced) that Harris County officials simply could not abide by it. The county did not have the equipment necessary to make the desired copies and could not get them in time to keep up with the election timetable. Because of this last-minute advisory, County Clerk Diane Trautman made a decision to physically transport all election results to a single point and manually feed them into a single machine thus doing away with the electronic transmission concerns. It is this process of physically transporting election results to a single point and feeding them into a single machine that resulted in the 12-hour delay in announcing election results.

This is the point however that you must not miss. Republicans have been running Harris County elections way before Democrat Diane Trautman came along. Their chosen method of transmitting election results(via modem) has been widely criticized by Houston area Computer Scientists, notably Professor Dan Wallach of Rice University, as being very unsafe and susceptible to hacking. Houston Public Media’s Jen Rice, who wrote a piece about this election feud, spoke to the aforementioned Prof Wallach who told her, “We found that this particular modeming process[used by Republicans] was really not secure….and that has been used unmodified despite our findings for a decade.” 

Despite decades-long concerns by Harris county residents, neither Republican Harris county officials nor the Texas Secretary of State have deemed it prudent to institute the election security advisory they suddenly imposed on Democrat Diane Trautman–copying election data before transmitting them electronically. In other words, Texas Secretary of State has known for decades that transmitting election results via modem was not secure and violated Texas election law(which mandates a secure method of transmission), but allowed Republicans to do it anyway. Their concerns about election security have only been stoked now that Democrat Trautman is in charge. Texas election law specifically bans the use of modems during tabulation yet the Texas Secretary of State has allowed Harris County Republicans and possibly other counties to do that anyway, for decades. It is only now that a Democrat is in charge that they are applying the law.

For the record, reasonable people can disagree as to which mode of election data transmission is more secure–the Republican modem or the Democratic Party’s intranet. All reasonable people will agree however that making a copy of election results before transmitting them electronically is a necessity when there are concerns about the security/safety of election data during transmission. The question now confronting Harris county Republicans and the Republican Secretary of State is why for all these years, they have transmitted election results electronically using non-secure modems, without first making a copy of the data? You don’t have to take Yours Truly’s word for it, Harris County Clerk Diane Trautman made the same argument to Houston Public Media’s Jen Rice. Trautman said, “The one that my predecessor used[modems] last November was over a cellular network, which is the internet. So he was violating this 10-year law that the Secretary of State brought up.”

More importantly, Diane Trautman added that the last-minute advisory from Secretary of State Hughs’ office came as a result of political pressure put on her by the Harris County Republican Party and specifically, Harris County GOP Chairman Paul Simpson. This is a very serious allegation which definitely deserves to be investigated further. If Texas Secretary of State Hughs is being unduly influenced by partisan politicians when making decisions about the state’s election procedures, then she needs to resign immediately.

Trautman told Houston Public Media, “I believe it’s common knowledge that the Secretary of State admitted to our County Attorney that the Harris County Republican Party put pressure on the Secretary of State to make this last minute advisory.” Harris County GOP Chair Simpson denied this allegation saying, “The advisory went out before the Republican Party was even involved….To my knowledge, we didn’t ask for any advisory.”

Bottom line folks, there are three crucial questions here that beg for some serious answers. First, why has the Texas Secretary of State allowed Republicans to use modems for election data transmission for decades when Texas election law expressly forbids that? Secondly, why didn’t the Texas Secretary of State impose the “copy before electronically transmitting” rule before Democrat Diane Trautman came along? Thirdly, was the last-minute advisory the result of political pressure from Harris County Republican Party officials? A serious investigation needs to be conducted over this third question and if proven, Secretary of State Hughs must resign.

Did Koch Industries Bribe Cornyn As Texas AG?

An interesting Texas Monthly piece from way back in 2000 suggests that then Texas Attorney General John Cornyn went easy on the powerful Koch industries after they polluted Texas waters in return for their support for him during his 1998 campaign.

John Cornyn was a judge at the Texas Supreme Court from 1991 to 1997 and was elected Texas Attorney General in 1998. Prior to his stint at the Texas Supreme Court, Cornyn was a judge at the Texas 37th District Court.

According to the Texas Monthly piece, pipelines belonging to Wichita-based Koch Industries leaked oil products into the waters of Texas and several other states. The federal government went after Koch Industries for violations of the Clean Water Act and several states including Texas joined the lawsuit. Texas attorney General at that time was Dan Morales (Cornyn’s predecessor). AG Morales is famous for the major win he scored against the Tobacco industry that netted the Lone Star state a staggering $17.3 billion in fines from Big Tobacco.

It is against the backdrop of AG Morales’ win against Big Tobacco that Koch Industries backed John Cornyn’s candidacy for Texas AG–in essence to shield themselves from having to pay astronomical fines to the Lone Star state as Big Tobacco did. So you say, “OK @Emolclause you’re really grasping at straws here. Cut to the chase and explain how Koch Industries recruited Cornyn to avoid paying astronomical fines to the Lone Star state after polluting its waters.” Here it is in a nutshell.

As the Texas Monthly piece correctly points out, going after Big Tobacco, Big Oil etc in court usually involves very complex litigation that requires a battery of “cream of the crop” attorneys. Needless to say, such attorneys charge astronomical fees for their services–fees that most state elected officials(AGs) feel uncomfortable paying using taxpayer funds. What most states end up doing therefore (at least before AG Cornyn came along) is that they enter into agreements with these smart attorneys whereby the attorneys take on the complex litigation without any payment from the state in return for a share(percentage) of the fines they recoup from the offending company. In the case of Big Tobacco for example where Texas netted an astronomical $17.3 billion in fines, the attorneys in the case ended up getting paid a whopping $3.3 billion.

AG Morales attempted to duplicate his success against Big Tobacco in his fight against Koch Industries by using the same technique of a battery of smart attorneys not paid by the state. Koch Industries backed Cornyn’s campaign for Texas AG in 1998, donating $5000 to his campaign. Cornyn went on to win the election in 1998 and when he became AG, immediately began fighting the practice of using “outside” lawyers for complex litigation like the one the state was pursuing against Koch Industries. Cornyn wanted only state attorneys(from the AG’s office) to handle the complex litigation against Koch Industries and others–an obvious legal advantage to the big companies. He used the straw argument that the staggering $3.3 billion paid to attorneys in the Big Tobacco case should have ended up in the state’s coffers instead.

What ended up happening is that the high-powered attorneys AG Morales had lined up to go to trial against Koch Industries left and the Lone Star state was forced to accept a paltry $35 million settlement from Koch, a settlement that deeply angered environmentalists. Most experts agree that had Cornyn allowed Morales’ attorneys to take Koch to trial, they were looking at a possible $225 million or more in fines. Obviously some of the $225 million would have gone to pay the attorneys’ fees but the Lone Star state would still have ended up with more than the paltry $35 million “slap on the wrist” settlement Cornyn got. Therefore Koch essentially backed Cornyn as AG in order to save themselves from paying astronomical fines to the state for polluting its waters. Sad indeed!!

Cornyn when confronted about this “slap on the wrist” settlement against Koch industries reportedly answered that it was “pretty darned good for a Republican.” In other words he did not aggressively pursue Koch Industries as much as he should because they traditionally supported Republicans.

Even more troubling is the fact that Cornyn assailed his GOP primary opponent in the Texas AG race for engaging in the exact similar conduct he was now excusing–taking money(contributions) from a company the Texas AG’s office was pursuing in court. This means Cornyn knew what he was doing was unethical but did it anyway.

It also cannot be left unsaid that the Texas Monthly piece accused John Cornyn of “playing politics with the law at the expense of the public interest.”  This is especially instructive now that he is running for reelection in 2020. Hopefully his Dem challengers will dig into this excellent Texas Monthly piece to dig up other troubling aspects of John Cornyn’s political career

Bottom line, Texas has always been assumed to be a reliably “red state” by much of the national mainstream media and indeed by some establishment Democrats. Yours Truly challenged this notion back when nobody thought Beto O’Rourke had any chance against Ted Cruz and we saw what happened. The same needs to happen with John Cornyn, whose long record both in Texas politics and as U.S. Senator provides ample oppo-research fodder for his prospective Dem challenger. Yours Truly will certainly do his part to expose John Cornyn for the corrupt politician he has always been, beginning with this shady deal he did for Koch Industries against the best interests of the Lone Star state.

El Paso Shooter’s Manifesto Echoes John Cornyn’s Tweet

After the deadly weekend shootings in El Paso Texas and Dayton Ohio, the President’s hateful rhetoric and especially his hardline stance on immigrants has taken center stage. A recent tweet by Senator John Cornyn(R-TX) is also getting closer scrutiny because some claim the El Paso shooter’s manifesto echoed similar anti-Hispanic sentiments as Senator Cornyn’s tweet–that Hispanics are replacing Whites in Texas.

Now we can all agree that it is unfair to pin any national tragedy on a politician’s previous public comments and Yours Truly is certainly not suggesting here that the El Paso shooter read Senator Cornyn’s tweet and then decided to open fire on Hispanic shoppers at a Walmart in El Paso. What is fair debate however is that President Trump has a well documented history of stoking racial tensions using very incendiary language that has even garnered praise from White Supremacy groups. It is also well known that Congressional Republicans like Senator Cornyn rarely push back on the President when he engages in such hateful rhetoric, the subject of Yours Truly’s recent post “GOP Complicit In Trump’s Racism”

Therefore when a hate crime against Hispanic shoppers like the one that happened in El Paso takes place, it is fair to confront Senator John Cornyn and other Republicans about their decision to remain silent even when the President engages in race-baiting speech. In Senator Cornyn’s case in particular, his tweet pointing out the fact that the Hispanic rate of migration to the state of Texas outnumbers that of Whites by a 9 to 1 margin certainly raises justifiable questions in light of the El Paso shooting. Was Senator Cornyn pushing the “White Replacement” conspiracy theory that is very popular among White Supremacy Groups worldwide?

It is well known that one of the grievances raised by hate groups and especially White Supremacists worldwide is this idea of “White Replacement”—that somehow there’s a global conspiracy to replace the White race with other ethnic groups. You’ll remember during the Charlottesville, Virginia riots, that White Supremacy advocates could be heard chanting “Jews will not replace us”. This “White Replacement” hysteria is fueling the growth of anti-immigrant political groups in Western Europe and some political pundits argue is the same hysteria currently being pushed by President Trump and his GOP with their harsh anti-immigrant rhetoric. It is therefore perfectly in order for Senator Cornyn to be questioned about the motivation behind his 9 to 1 tweet.

It also cannot be left unsaid that during a recent Congressional hearing, Rep Alexandria Ocasio-Cortez took Deputy FBI Director Michael McGarrity to task over why the FBI and other law enforcement agencies(like DHS) are not doing more to combat the rising threat of domestic terrorism posed by White Supremacy groups, a subject Yours Truly wrote about in “AOC Exposes FBI’s Terrorism Double Standard” . (AOC is always ahead of the curve folks).

Deputy Director McGarrity’s response was that there are no current laws/legal provisions that allow the FBI to vigorously go after domestic terrorists. The question then becomes, how does the same FBI and DHS currently target people they perceive to be “Black extremists” or “Black militants”? What current provisions/laws are they basing these surveillance practices on, that they are seemingly unwilling or unable to apply to White Supremacists? There have been numerous credible media reports that surveillance on “Black militants” is indeed happening as we speak in most major U.S. cities–some for reasons as mundane as anti-Trump/DHS social media posts, or even organizing,/participating in Black Lives Matter protests. Are these media reports “fake news”? These are some of the questions the public expects the mainstream media to pose to FBI and DHS brass in light of the two deadly weekend mass shootings.

Bottom line, the mainstream media fails the public miserably in the way it covers national tragedies. Specifically, the questions that need to be answered are often not answered because other incidents usually pop up and take the cameras/spotlight away. The El Paso shooting has raised two very important questions that needs to be addressed the first one being how surveillance capabilities of the FBI and DHS are being misused/abused. Are the FBI and DHS wasting surveillance resources needlessly chasing down perceived “militants” of color while totally ignoring the actual threat of domestic terrorism by White Supremacists? The second question (a no-brainer), is whether the hate-filled rhetoric emanating from President Trump and his Republican party is fueling the rise White Supremacy groups in the U.S.? These are two questions the mainstream media must seriously delve into in the aftermath of the two deadly shootings in El Paso and Dayton. The Mainstream media will likely give Trump and Senator John Cornyn a pass as they usually do with Republicans. However you can rest assured that Yours Truly, your trusted grassroots journalist, will not only hold Sen Cornyn’s feet to the fire regarding this racist tweet, but will also and make it the citadel upon which his 2020 reelection prospects fail. Its Officially “Operation Defeat John Cornyn” In Texas

After Democrat Beto O’Rourke’s heart-breaking loss to incumbent GOP Senator Ted Cruz, many Texas Democrats are left wondering what to do with the groundswell political energy generated by the highly inspiring Beto campaign. Many including Yours Truly are yet to accept Ted Cruz’s “win” given the troubling reports that the eSlate voting machines switched some Beto votes to Ted Cruz. There has been no follow up on this story by the mainstream media or #TeamBeto as to exactly how many votes were switched by the eSlate machines meaning we are stuck with Senator Ted Cruz for the next six years.


The good news however is that Texas Democrats have a fresh opportunity to avenge Beto’s heart-breaking loss to Ted Cruz. The other U.S. Senator from Texas, John Cornyn is up for re-election in 2020 meaning Texas Democrats have a perfect opportunity to take out all their frustrations over Beto’s loss on him. Sen Cornyn is also Mitch McConnell’s right hand man in the GOP-controlled U.S. Senate which should provide added impetus for Texas Dems to vote him out in 2020. Simply put, its officially “Operation Defeat John Cornyn” in Texas.

Also good news for Texas Democrats is that the Harris County Clerk(Houston area) is now a Democrat and she has already promised to phase out the problematic eSlate machines before 2020. There is also tremendous momentum in Dallas, Austin and San Antonio regions that vote heavily Democratic to come up with more reliable voting machines before the 2020 elections.

Bottom line, it appears we have lost the fight over Ted Cruz’s seat. We should therefore start focusing our energy on the upcoming 2020 fight against Senator John Cornyn and make sure we flip that senate seat blue. It will be very interesting to see which Texas Democrat steps up to the plate to take on Senator John Cornyn in 2020. Will it be Beto 2.0, Lizzie Pannill Fletcher(TX-07), former NFL linebacker Colin Alred(TX-32), or….? Folks there are a lot of quality Dems to go up against Senator Cornyn in 2020. We must flip Cornyn’s senate seat blue!
